Illegal cryptocurrency mining operations in Russia are facing new regulations that could result in heavy fines and the seizure of digital assets. The Ministry of Digital Development, Communications, and Mass Media in Russia has proposed these new rules, which are currently undergoing review by various government departments.
According to a report from Forbes Russia, if these regulations are approved, law enforcement agencies and courts will have the authority to confiscate cryptocurrencies from individuals engaged in illegal mining activities. Judges will also be able to impose fines ranging from 100,000 to 200,000 rubles ($1,272 to $2,544) on offenders.
Individuals found participating in illegal mining pools could face fines and have their digital assets confiscated. Solo entrepreneurs and officials may be subject to even harsher penalties, with fines ranging from 200,000 to 400,000 rubles ($2,544 to $5,088).
Industrial miners who violate crypto mining regulations could also have their assets seized, with fines of 1 million to 2 million rubles ($12,728 to $25,456) imposed by the courts. The Ministry is seeking to amend the country’s Code of Administrative Offenses to criminalize illegal mining activities.
Last year, a law was enacted allowing unregistered individuals in Russia to mine cryptocurrencies at home as long as they do not exceed 6,000 kWh per month. However, mining restrictions apply in certain regions, and individuals with certain criminal convictions are prohibited from engaging in crypto mining activities.
The Ministry is also targeting individuals and businesses that use cryptocurrencies for settlements outside of the Central Bank’s crypto sandbox. Violators could face fines of up to 1 million rubles ($12,728), with the threat of asset confiscation serving as a deterrent.
The Central Bank believes that confiscating digital assets from those conducting business in cryptocurrency will have a greater impact. Andrey Medvedev, the bank’s Legal Department lead, emphasized the significance of confiscation as a deterrent at a recent legal forum.
The draft law also includes provisions for mining infrastructure operators to declare their operations to the anti-money laundering agency, Rosfinmonitoring. These operators, which typically include data center providers and crypto mining hotels, must disclose information about the crypto mined at their facilities and their wallet addresses.
Despite these new regulations, the government recently decided against imposing new mining bans in additional regions of Russia. The energy commission chaired by Deputy Prime Minister Alexander Novak rejected a proposal to ban mining in Khakassia and postponed a year-round ban in other regions.
