However, this moment of joy was short-lived as the Bybit hack served as a stark reminder of the unpredictable nature of crypto news.
SEC’s Latest Moves and What They Mean
The significance of the SEC’s decision to dismiss the case against Coinbase “with prejudice” cannot be understated. This signals that the SEC does not intend to reopen the case in the future. Additionally, the joint filing to “stay” the SEC-Binance case indicates a shift in the agency’s regulatory approach towards crypto exchanges.
Arie Heijkoop, a partner at Haynes Boone, highlighted the agency’s methodical review of each case on its merits, rather than a blanket reversal of similar open matters. The 60-day postponement in the Binance case could potentially indicate a self-imposed timeline for future guidance from the SEC.
Implications for the Future
Despite the uncertainty surrounding the SEC’s regulatory stance, there is movement within the agency. Bitwise general counsel Katherine Dowling noted that cases with evidence of fraud are likely to proceed, while those involving digital asset classification may be resolved through settlement or dismissal.
Hester Peirce’s statement on classification issues further sheds light on the SEC’s thought process in this regard. It is clear that there is no one-size-fits-all approach to regulating coin issuances.
Looking Ahead
With the SEC closing its investigation into Robinhood and opting not to pursue an enforcement action, the focus now shifts to the Ripple litigation. Dowling anticipates that action in the Ripple case will follow soon, given the agency’s prolonged battle with the company.
