Do Kwon, the former CEO of Terraform Labs, has recently pleaded guilty to federal fraud charges in a Manhattan court. His sentencing is scheduled for December 11th, where he will face the consequences of orchestrating a cryptocurrency scheme that led to significant losses for investors. The collapse of LUNA and TerraUSD tokens in May 2022 resulted in over $40 billion in losses, according to prosecutors.
During the court proceedings, Kwon admitted to making false statements about Terra’s operations and acknowledged that his actions were misleading to investors. The guilty pleas entered by his defense include charges of conspiracy to defraud and wire fraud. Judge Paul Engelmayer at the Southern District of New York (SDNY) courthouse presided over the case.
As part of the plea agreement, Kwon is facing financial penalties exceeding $19 million and potential imprisonment for up to 25 years. However, prosecutors have agreed to recommend a maximum of 12 years if he takes responsibility for his actions and refrains from committing any further crimes. The charges against Kwon carry a statutory maximum of 25 years, with conspiracy charges accounting for five years and wire fraud for 20 years.
The collapse of the Terra ecosystem had a significant impact on the cryptocurrency market, causing widespread sell-offs and erasing billions in market capitalization. FatMan, a key figure in the post-collapse investigations, commented on Kwon’s guilty plea, suggesting that he may serve 15 to 20 years in prison instead of the maximum sentence.
Following the collapse, Kwon spent nearly a year on the run before being apprehended by Montenegrin authorities in March 2023. He was attempting to travel using fraudulent passport documentation at the time of his capture. After fighting extradition proceedings, Kwon was ultimately transferred to US custody to face the charges against him.
