Eliza Labs and founder Shaw Walters recently made headlines by filing a federal antitrust lawsuit against social media platform X. The lawsuit, dated August 27, alleges that X engaged in fraudulent behavior by extracting technical information about Eliza’s AI agents before deplatforming them and launching competing products. The plaintiffs are seeking damages exceeding $75,000 and immediate restoration of their account.
In a statement released on August 28, Walters described the lawsuit as a last resort after months of failed negotiations with X. He emphasized that the lawsuit was necessary to address the anticompetitive conduct that Eliza Labs had experienced at the hands of the social media platform.
The lawsuit is based on antitrust claims, which aim to challenge practices that harm fair competition and protect consumers. Eliza’s complaint specifically alleges that X violated Section 2 of the Sherman Act by using its monopoly power in short-form social media to suppress AI competition.
The lawsuit outlines how X suspended Eliza’s accounts in June 2025 and then demanded extensive technical documentation under the guise of reinstating the account. Walters claims that X used this information to develop AI features that were nearly identical to Eliza’s, including 3D avatars, voice integration, and telephone capabilities.
The remedies sought in the lawsuit include a declaratory judgment that X lacks Section 230 immunity for anticompetitive deplatforming, injunctions preventing future exclusionary conduct, and account restoration with full platform access. Monetary remedies include disgorgement of X’s unjust enrichment, compensation for fraudulent misrepresentation and unfair competition damages, as well as treble damages under the Sherman Act provisions. The plaintiffs also request punitive damages and attorneys’ fees.
This lawsuit comes on the heels of Elon Musk’s xAI suing Apple and OpenAI on August 25, alleging a conspiracy to suppress AI competition through Apple’s exclusive ChatGPT integration and App Store favoritism. The lawsuit claims that Apple’s partnership with OpenAI makes it impossible for any AI company besides OpenAI to reach #1 in the App Store.
These legal battles highlight the escalating tensions in the AI market control landscape, with both Eliza Labs and xAI pursuing antitrust claims against major players in the industry. The outcomes of these lawsuits could have significant implications for the future of AI development and competition in the tech sector.
