Do Kwon, the co-founder of Terraform Labs, has been extradited from Montenegro to the US, putting an end to months of legal battles. This development comes after Kwon was arrested in March 2023 in Montenegro for attempting to travel with a fake passport. Since then, he has been fighting extradition to the US and was seeking repatriation to South Korea. However, Montenegro’s judiciary denied his appeals, leading to his transfer to US authorities at Podgorica International Airport on Dec. 31.
The extradition is related to the collapse of the TerraLUNA ecosystem in 2022, which resulted in the loss of roughly $40 billion in market value. TerraUSD, a stablecoin designed to maintain parity with the US dollar, de-pegged sharply, causing significant losses for investors. The crash had a ripple effect on the broader crypto market, leading to regulatory scrutiny and allegations of fraud.
Kwon co-founded Terraform Labs in 2018, with TerraUSD being promoted as a groundbreaking decentralized financial tool. However, critics raised concerns about the sustainability of the algorithmic model supporting TerraUSD’s stability. When the stablecoin’s value plummeted, the collapse of Luna, the accompanying token, exacerbated the losses, with the total market value of both tokens declining by an estimated $33.9 billion.
Following the collapse, South Korean authorities issued a warrant for Kwon’s arrest on charges of fraud and tax evasion. Investors also filed lawsuits alleging that Kwon and his company operated a Ponzi scheme, deceiving them about the viability of TerraUSD and Luna.
Interpol issued a red notice for Kwon in September 2022, designating him as a high-priority international fugitive. Despite this, Kwon managed to evade authorities for months, allegedly moving between various countries before being apprehended in Montenegro. During his arrest, it was discovered that Kwon was using falsified Costa Rican and Belgian passports, leading to additional charges of document forgery.
While South Korea sought Kwon’s extradition to face charges domestically, Montenegrin authorities prioritized his extradition to the US. In the US, Kwon is expected to stand trial for securities fraud, wire fraud, and conspiracy related to the collapse of Terraform Labs’ cryptocurrencies.
The extradition of Kwon highlights the challenges and risks within the crypto industry. The collapse of TerraUSD has sparked calls for tighter oversight of digital assets globally, with regulators warning about the systemic risks posed by poorly managed stablecoins. Kwon’s trial in the US is anticipated to shed light on his role in one of the largest financial collapses in crypto history, marking a new phase in the quest for accountability in the crypto sector.
